Windham man indicted on numerous charges alleging that he raped girl 9.
An Windham man is charged with several counts of rape as well as other charges that he sexually assaulted an now nine-year-old girl in 2017 and used a firearm to harass her.
Cody M. Gritten, 29, is accused of five counts of felony rape in the first degree as well as two counts of second degree attempted rape felony and one count of third-degree criminal intimidation according to an indictment by a grand jury that was filed on Thursday in the Portage County Court of Common Pleas.
Gritten is also charged with fifth degree infraction of possession of tools used for criminal purposes which is described within the charges as a sexual instrument.
As per the charges the sexual assaults occurred from July 12 to between July 12, 2017 and Dec. 4, which included one attempted rape and two attempted rapes specifically on or around December. 4.

One rape and the intimidation charge include a specification that states Gritten had a gun and a separate description that the firearm was an .45-caliber pistol that was used to commit the crime, and/or to threaten the victim.
The charges of attempted rape include the specifics that Gritten was more than 16 years old and the girl was less that 10 years old at the time of the alleged crime.
The Portage County Sheriff’s Office said Gritten was detained after it issued a search warrant for the Cloverleaf Road home on Dec. 15 in the course of an investigation into claims that he assaulted the minor.
The sheriff’s office was informed of the presence of guns within the home. Police from the Portage County SWAT Team and the sheriff’s Drug and Violent Crime Unit were also on the scene.
The sheriff’s office reported multiple guns, ammo, approximately 3 pounds worth of marijuana approximately 50 cartridges of THC Vicodin and oxycodone tablets typically used for transportation of controlled drugs as well as about $50,000 worth of cash were found during the investigation. The sheriff’s office stated that the investigation is in progress.
Gritten first was arrested on one charge of felony rape in the first degree within Portage County Municipal Court in Ravenna.
He is scheduled to be arraigned on Tuesday. He’s currently in the Portage County Jail on a $1 million bond, which was set by the city court.
